Treaties:
Qatar is a member of Paris Convention, Patent Cooperation Treaty PCT, and Budapest Treaty.
Trademarks
Trademark search:
A pre-filing search is recommended before proceeding with filing the trademark application to avoid further examination obstacles.
Filing Requirements:
1.A Power of Attorney, duly legalized up to the Qatari Consulate.
2. Representation of the trademark, photographs or drawings of the trademark.
3.A list of the goods and services to be covered by the application.
4.In case of claiming priority, a certified copy of the corresponding home or foreign application.
Trademark Examination:
As to form, absolute, and relative grounds.
Publication and Registration
Accepted Trademarks are published, if no oppositions submitted, the trademarks registered.
Term of Protection:
10 years from filing date with renewable for similar periods.
Patents
Filing Requirements:
1. A Power of Attorney duly legalized up to the Qatari Consulate.
2. The Abstract, specification, claims; and drawings, if any, in English, along with the Arabic translation thereof (can be conducted from our side).
2. A Deed of Assignment from the inventor (s), duly legalized up to the Qatari Consulate.
3. An Extract from the Commercial Register or Certificate of Incorporation, or any equivalent document, duly legalized up to the Qatari Consulate.
4. In case of claiming priority, a certified copy of the corresponding home application, duly legalized up to the Qatari Consulate. The Arabic translation is required (can be conducted from our side).
Patent Examination:
As to form and Substantive Examination (unity, novelty, inventive step, industrial applicability).
Annuities payment:
The patent annuity must be paid annually at the anniversary of the international filing date.
Term of Protection:
20 years from filing date or corresponding PCT application filing date, not renewable
Industrial Designs
Although Qatari Authorities issued the Law no. 10 of 2020 on the Protection of Industrial Designs on April 19, 2020, but the implementing regulations have not been issued yet. Since, it is not possible to file Design application in Qatar. The Designs protection could be sought out by publishing cautionary notices, in Arabic and English, at regular intervals in local Qatari newspapers to claiming the designs ownership and to alerting third parties against any infringement.
