Kuwait is a member of Paris Convention and Patent Cooperation Treaty PCT.
Trademarks
Trademark search:
A pre-filing search is recommended before proceeding with filing the trademark application to avoid further examination obstacles.
Filing Requirements:
1.A Power of Attorney, duly legalized up to the Kuwaiti Consulate.
2. Representation of the trademark, photographs or drawings of the trademark.
3.A list of the goods and services to be covered by the application.
4.In case of claiming priority, a certified copy of the corresponding home or foreign application.
Trademark Examination:
As to form, absolute, and relative grounds.
Publication and Registration
Accepted Trademarks are published, if no oppositions submitted, the trademarks registered.
Term of Protection:
10 years from filing date with renewable for similar periods.
Patents
Filing Requirements:
1. A Power of Attorney duly legalized up to the Kuwaiti Consulate.
2. The Abstract, specification, claims; and drawings, if any, in English, along with the Arabic translation thereof (can be conducted from our side).
2. A Deed of Assignment from the inventor (s), duly legalized up to the Kuwaiti Consulate.
3. An Extract from the Commercial Register or Certificate of Incorporation, or any equivalent document, duly legalized up to the Kuwaiti Consulate.
4. In case of claiming priority, a certified copy of the corresponding home application, duly legalized up to the Kuwaiti Consulate. The Arabic translation is required (can be conducted from our side).
Patent Examination:
As to form and Substantive Examination (unity, novelty, inventive step, industrial applicability).
Annuities payment:
The patent annuity must be paid annually, and due for payment at the first quarter of each year (January 1st to March 31st) subsequent to the year in which the application was filed.
Term of Protection:
20 years from the corresponding PCT application filing date, not renewable
Industrial Designs
Filing Requirements:
1. A Power of Attorney duly legalized up to the Kuwaiti Consulate.
2. Photographs or drawings of the design with high resolution.
2. A Deed of Assignment from the Designer (s), duly legalized up to the Kuwaiti Consulate.
3. An Extract from the Commercial Register or Certificate of Incorporation, or any equivalent document, duly legalized up to the Kuwaiti Consulate.
4. In case of claiming priority, a certified copy of the corresponding home application, duly legalized up to the Kuwaiti Consulate.
Designs Examination:
As to form and Substantive Examination (novelty examination).
Publication and Registration
Accepted Design are published, thereafter, the designs are registered.
Term of Protection:
10 years from filing date, renewable for further 5 years.
