Turkish Patent and Trademark Office (TÜRKPATENT) has recently implemented new official fees for patents, utility models, trademarks, and designs, marking a significant change in the intellectual property landscape as of January 1, 2024.
The adjustment in fees is notable, with most experiencing an average increase of approximately 30%. However, certain fees have remained unchanged, providing some stability amidst the revisions. Among the fees subject to adjustment are those commonly encountered in the application and registration processes.
For instance, the official filing fee for patent or utility model applications has surged to 337.24 TRY from 224.74 TRY, representing an approximate 33% increase. Conversely, the official fee for validating a European patent has remained constant at 9,061.02 TRY, along with the fees for PCT national phase entries as both a patent and a utility model, remaining steady at 5,898.31 TRY and 3,691.53 TRY, respectively.
Similarly, the official filing fee for design applications has seen a significant increase, rising to 1,120.23 TRY from 758.58 TRY, marking around a 32% increase. Moreover, the fee for the renewal of a design registration has spiked to 3,432.59 TRY from 2,314.34 TRY, demonstrating a 33% increase.
In the realm of trademarks, the adjustments are equally impactful. The official filing fee for a trademark application in one class has surged to 1,498.24 TRY from 1,030.54 TRY, marking a 33% increase. Furthermore, the fees for trademark renewal and registration have both experienced notable increments, rising to 4,379.89 TRY from 3,162.29 TRY, and to 3,522.95 TRY from 2,536.60 TRY, respectively, both indicating a 28% increase.
Despite these changes, TÜRKPATENT maintains a consistent fee structure for all entities, except for search and examination fees for patents and utility models, where distinctions exist based on entity type. Search fees stand at 1,810.17 TRY for legal entities and 884.75 TRY for real persons, while examination fees mirror these figures, maintaining parity.
